First published in 1917 and 1918, with a second edition in 1946, this is the first English translation of Santi Romano's classic work, L'ordinamento giuridico. The main focus of The Legal Order is the notion of institution, which Romano considers to be both the core and distinguishing feature of law. After criticising accounts of the nature of law centred on notions of rule, coercion or authority, he offers a compelling conception, not merely of law as an institution, but of the (...) institution as 'the first, original and essential manifestation of law'. Romano advances a definition of a legal institution as any group who share rules within a bounded context: for example, a family, a firm, a factory, a prison, an association, a church, an illegal organisation, a state, the community of states, and so on. Therefore, this understanding of legal institutionalism at the same time provides a ground-breaking theory of legal pluralism whereby 'there are as many legal orders as institutions'. The acme of a jurisprudential current long overlooked in the Anglophone environment, The Legal Order not only proposes what Carl Schmitt described as a 'very significant theory', but, more importantly, it offers precious insights for a thorough rethinking of the relationship between law and society in today's world. This article problematizes the recent comeback of the exceptionalist jargon as it is conjured by both critics and sympathizers. While in the last decades governments across the globe had recourse to emergency measures to cope with far-reaching emergencies, from terrorism to the COVID-19 pandemic, the received view has it that political power takes advantage of states of emergency as they put themselves in the position to circumvent constitutional limitations. Carl Schmitt is claimed to be the major advocate of this conception (...) of emergency politics in that he elaborated on the concept of the state of exception as the heart of the state political power. This article contends that the received view is doubly wrong. First, soon after his espousal of exceptionalism, Schmitt realized that emergency legislation is an ineffective and costly governmental device that should be transitory and is as unstable as the crisis it is meant to overcome. Second, the received view neglects how Schmitt came to his model of ultraconservative substantive constitutionalism as he maintained that the main task of politics is to protect the normative life of a limited set of state-sponsored institutions as well as the substantive contents they produce. ABSTRACTThis article offers an unconventional interpretation of Carl Schmitt’s conception of the political. It first identifies two alternative readings – an ‘exceptionalist’ and a ‘concretist’ one – to make the claim that in the late 1920s he laid the foundations for a theory of politics that overcame the flaws of his theory of exception. It then explains why the concretist reading provides an insightful key to Schmitt’s take on the relationship between politics and law as a whole. Despite this, the (...) chief aim of this analysis is not interpretive. Rather, the article claims that such a paradigm change was related to Schmitt’s pondering on the elements that were menacing to draw the experience of modern statehood to an end even more seriously than any upheavals and revolutions. For he came to the conclusion that the mere claim to political self-sufficiency on the part on non-state social entities was able to defy the idea of the state as the political entity par excellence. While these reflections urged Schmitt to reformulate many features of his conception of the political, the article contends that this particular juncture in his production sheds light on a crucial feature of contemporary politics. In the recent literature on militant democracy, two claims are made on the relation between its most famous advocate, Karl Loewenstein, and German jurist Carl Schmitt. The first claim is that, although the latter came to support the Nazi regime, in the late 1920s he provided an early model of militant democracy that looks more robust and elaborated than Loewenstein’s. Schmitt’s constrained democracy is believed to cut deeper into that which militancy is supposed to safeguard. The second claim is that (...) this latter model underlies other versions of militant democracy, including Loewenstein’s. This article argues that the first claim is largely correct while the second is to be rejected. In doing so, it delves deep into Schmitt’s understanding of the materiality of law, that is, the social normativity that he believed the constitution was designed to protect, and casts light on the procedural orientation of Loewenstein’s militant democracy. The conclusion is that both these theories espouse a form of conservatism, though different from one another, and that in different ways both can be detrimental to democracy. (shrink)

This article offers an in-depth analysis of Carl Schmitt's social ontology to explain how and why he came to reject exceptionalist decisionism. To this end, the authors unearth the considerable shifts in terms of social ontology that paved the way for this conceptual turn. The gist of their argument is that Schmitt's Political Theology (1922) espoused a Hobbesian conception of the political as the possibility condition for stable patters of social interaction. Though the first three chapters of Political Theology were (...) originally designed for and published in a posthumous Festschrift for Max Weber, his understanding of the social was indebted to a Hobbesian legacy. Nonetheless, shortly thereafter, he began to revise his conception of the social and to put stress on the organisational dynamics of social institutions as independent of there being a political authority. From 1927 through to 1950, Schmitt never got back to his 1922 exceptionalist view of politics and rather sought to make sense of how the state could and should draw the contents of the legal order from the normative life of social institutions. El judío, en cambio, coloca las palabras una junto a otra sin comprenderlas; es el gramático el que asegura la construcción perfecta de las frases, de la gramática.In this work I would like to see the relation in the Abelard’s Dialogue betwenn a Philosopher and the dialectic; a Christian and the rethoric and a Jew and the granmmar. I want that the charecters talk and discuss their position. It is a Dialogue of three people. The Philosopher look for the blessdness with the virtue and the dialectic. The Philosopher sais that the salvation come for the dialectic and no by the rites. The Christian remembers the teachers William of the Champeau and Anselm of the Laon who had the easy word and used the Rethoric vary good. Tomando apoyo en la rotunda sugerencia especulativa de una obra de arte contemporánea, el trabajo examina la aspiración al sentido de la declaración de que «la vida es deseo», un ejemplo cualquiera de Lebensphilosophie, desde la crítica wittgensteiniana del discurso filosófico, con el Tractatus y las Investigaciones como sucesivo telón de fondo. Se llega por este camino a la conclusión de que el vitalismo sería constitutivamente unsinnig. Pero habría otros fragmentos de la obra del filósofo vienés que nos harían ver (...) que podría contener una suerte de «verdad» estética, con lo que terminamos ensayando una apelación al criterio nietzscheano de verdad con la esperanza de poder entender mejor la cuestión. In this study, we examine the influence of senior leadership on firms’ corporate social responsibility. We integrate upper echelons research that has investigated either the influence of the CEO or the top management team on CSR. We contend that functional experience complementarity between CEOs and TMTs in formulating and implementing CSR strategy may underlie differentiated strategies in CSR. We find that when CEOs who have predominant experience in output functions are complemented by TMTs with a lower proportion of members who (...) have experience in output functions, there is a pronounced effect on the community, product, and diversity dimensions of CSR. In turn, when output-oriented CEOs are complemented by output-oriented TMTs, we observe an effect on the employee relations dimension of CSR. Interestingly, we find no influence of CEO-TMT complementarity on the environment dimension of CSR. In general, our empirical results support the relevance of the interaction between CEOs and their TMTs in defining their firms’ CSR profile. (shrink)

The Somatic Mutation Theory has been challenged on its fundamentals by the Tissue Organization Field Theory of Carcinogenesis. However, a recent publication has questioned whether TOFT could be a valid alternative theory of carcinogenesis to that presented by SMT. Herein we critically review arguments supporting the irreducible opposition between the two theoretical approaches by highlighting differences regarding the philosophical, methodological and experimental approaches on which they respectively rely. We conclude that SMT has not explained carcinogenesis due to severe epistemological and (...) empirical shortcomings, while TOFT is gaining momentum. The main issue is actually to submit SMT to rigorous testing. This concern includes the imperatives to seek evidence for disproving one’s hypothesis, and to consider the whole, and not just selective evidence. (shrink)

In Knowing Things for Sure physicist and realist philosopher, Mariano Artigas traces the confusion to non-realist philosophies and argues that practitioners of experimental science do reach logical truths about reality.

The debate on the decline of the terms of trade in dependent countries was never fully integrated into the Marxist theory of dependency. The attempt to articulate it through the category of unequal exchange was not particularly systematic. This paper seeks to recover those debates and will attempt to account for the relevant articulations in the light of a present revitalisation of studies in the field of Marxist dependency theory. To this end, we will recover the classical discussions around unequal (...) exchange in order to discuss their points of contact with the Marxist theory of dependency and some contemporary debates around the transfer of value and the super-exploitation of labour and nature. El capítulo IV de De la ética a la metafísica es dedicado por Julia Iribarne al estudio del surgimiento de la cuestión de la identidad personal en el pensamiento de Husserl. El objetivo, trazado al inicio del cap., es la exposición de una suerte de “arqueología del sujeto” la cual tiene lugar entre dos polos: por un lado, lo que Husserl denomina fluyente presente viviente y, por otro, ese mismo yo concreto “visto ahora como persona única e irrepetible”. Un paso (...) importante en este proceso arqueológico tiene que ver con la identidad vista en el estrato de la persona moral. En relación con este estrato, este artículo pretende mostrar que las denominadas “emociones morales”, entendidas como vivencias interpersonales y, por tanto, sociales, desempeñan un papel muy importante en la constitución y en la revelación de la persona única e irrepetible que somos cada uno de nosotros. Para ello nos serviremos del reciente estudio de A. J. Steinbock, Moral Emotions. Reclaiming the Evidence of Heart inserto en su proyecto más amplio de lo que él mismo denomina “fenomenología vertical”.Chapter 4 of Iribarne’s De la ética a la metafísica deals with the question of personal identity in Edmund Husserl’s thought. The objective of this chapter is the exposition of a kind of “subject’s archaeology” which takes place between two poles: on the one hand, that what Husserl calls “fluent living present” and, on the other hand, this same concrete ego, but “now seen as unique and unique person”. An important step in this archaeological process has to do with personal identity considered on the level of the moral person. In this regard, this paper tries to show that the so called “moral emotions”, as interpersonal and therefore social experiences, play an important role in the constitution and revelation of the unique person each of us are. To do that I will refer to the recent book by A.J. Steinbock, Moral Emotions. Reclaiming the Evidence of Heart, which has to be considered in the more general frame of what he calls “vertical phenomenology”. In this way I try to develop Iribarne’s analysis on the mentioned chapter. (shrink)

El costo de tomar una decisión sobre la base de las creencias falsas varía en diferentes contextos de acción. En algunos casos el costo del error podría ser muy alto para el bienestar de los agentes afectados y en otros casos muy bajo. El contraste entre estos dos tipos de contextos ha sido recientemente objeto de atención en la epistemología. Mi objetivo en este trabajo es extender el análisis de algunas de las implicaciones de ese contraste al campo moral. En (...) particular, defenderé la tesis de que existen casos en los que un sujeto puede saber faliblemente que un curso de acción es el mejor desde una perspectiva moral y no estar, sin embargo, justificado a actuar sobre la base de ese conocimiento en el contexto en que se encuentra, dado el elevado costo que tendría que ese juicio fuese falso. Por lo tanto, en esos casos, existiría una brecha entre los conceptos de conocimiento moral y justificación moral de la acción. (shrink)

El presente libro es un trabajo de investigación conjunto del Departamento de Filosofía de la Universidad de Navarra y el Instituto K. J. Somaiya Bharatiya Sanskriti Peetham. Se trata de un estudio centrado en cinco filósofos que abarcan el período que va del siglo VIII hasta el siglo XVI; los filósofos estudiados pertenecen a la Escuela Vedanta cuyo objetivo principal es analizar la naturaleza del Ser Absoluto y sus relaciones con el universo increado de seres materiales y espirituales. A proposta de uma teologia pública da saúde visa o diálogo entre antropologia teológica e antropologias médicas e da saúde de modo a ampliar a percepção da saúde, não somente como fato, mas como valor. Mesmo um Estado Laico, suas tradições religiosas possuem hermenêuticas de saúde, ao interpretar a doença e a morte com razões religiosas distintas, ora conflitantes, ora cooperativas com as ciências da saúde. Ampliar essas hermenêuticas religiosas compondo a sabedoria de vida presente nas expressões religiosas e o (...) conhecimento científico da área de saúde visa uma cooperação para interesses de bem comum da sociedade civil, como é a questão da saúde. Para essa reflexão, a escola de Cós combina a sabedoria mítica asclepíade e a ciência jônia. Os mitos de saúde nomeados no juramento hipocrático pertencem à tradição da teologia poética grega e indica uma espécie de credo no qual a medicina hipocrática professa, no qual o médico além de profissional também possui fé na vida e exerce o ofício de sacerdote da esperança. Interessa ainda o modo como o a teologia da saúde grega foi recebida pela teologia cristã, e como ambas desconstruíram suas teodiceias. Nessa recepção há um caminho para pensar uma teologia pública da saúde. (shrink)

German lawyer and political scientist Karl Loewenstein is generally regarded as the originator of the militant democracy paradigm. In a series of articles in the mid and late 1930s, he argued that constitutional democracies should pre-emptively defend themselves against movements and parties that were seeking to undermine them. More recently, another father of the paradigm has been identified in the controversial figure of Carl Schmitt. Before his despicable and opportunistic support for the Nazi regime at the end of 1933, he (...) advocated a model of authoritarian democracy based on fundamental constitutional contents that should be made impervious to legislative change. This article examines the different models of disciplined and authoritarian democracy proposed by these authors. While both advocated measures that could inhibit the activity of parliamentary majorities composed mainly of parties opposed to the state constitutional structure, Schmitt, more than Loewenstein, made the point that the defence of democracy requires subscribing to substantive values and principles and entrenching them. The juxtaposition of these models makes it clear that militant democracy not only recommends the protection of certain procedures but also entails a normative standard comprising substantive contents. This helps to highlight the unstated normative burdens of democratic militancy. (shrink)

En este trabajo se analiza el concepto de Estado racional mediante tres perspectivas que de modo explícito o implícito se encuentran en el Fundamento del derecho natural de Fichte. Con la intención de mostrar la centralidad del concepto de Estado, en primer lugar se trata la perspectiva de la superfluidad y sus límites ; en segundo lugar se trata la perspectiva de la coacción, que también brinda un concepto de Estado negativo. En tercer lugar se trata la perspectiva que, sin (...) caracterizarlo negativamente, no obstante no alcanza una comprensión positiva del Estado, donde éste sea el concepto central de la filosofía social, política y económica de Fichte. Finalmente, a partir de El Estado comercial cerrado y Los caracteres de la edad contemporánea se esboza una clasificación sobre los diferentes conceptos de Estado desarrollados y contenidos bajo una unidad de sentido.
